Terms of Use

By accessing and using the Site, you acknowledge the Terms and agree, without limitation or qualification, to be bound by them and by applicable laws. If you do not agree to the Terms, you should not access or use the Site.

The Terms are current as of the date which appears at the top of this page. VIA HFR reserves the right to update the Terms at any time without prior notice and it is your responsibility to review the Terms periodically. Your continued use of the Site constitutes your acceptance of the Terms in effect at the time of such use.

VIA HFR may, but is not obligated to, monitor your access to, use of, and other activities relating to the Site. By accessing and using the Site, you agree that VIA HFR has the right to monitor the access and use of the Site and its content electronically from time to time and to disclose any information necessary to: (a) satisfy any legal, regulatory or other government request; (b) operate the Site properly; or (c) protect itself, other users of the Site, the whole in accordance with the Privacy Policy (as herein defined).

By accessing and using the Site, you consent to the terms of the policy established by VIA HFR governing its collection, use and disclosure of personal information, as amended from time to time (the “Privacy Policy”). Please carefully review the Privacy Policy accessible on the Site.

While VIA HFR makes commercially reasonable efforts to ensure that the information contained on the Site is accurate, VIA HFR cannot guarantee the accuracy, completeness, timeliness, or reliability of this information, and is not responsible for inaccuracies, errors, or omissions in the information. All information on the Site is for information purposes only; it is not intended to provide any specific advice and is not to be relied upon. You agree that the access and use of the Site is at your own risk.

As a condition of your use of the Site, you agree to comply with the Terms and with applicable laws. Without limiting the generality of the foregoing, you agree that by accessing and using the Site, you will not commit, participate in, or permit anyone to commit or participate on your behalf in any of the following acts, each of which is expressly prohibited by the Terms: (a) use the Site in any manner which could damage, disable, overburden or impair the Site; (b) interfere with or test the security of, or otherwise abuse, the Site, or any services, system resources, accounts, servers or networks connected to or accessible through the Site; (c) disrupt or interfere with any other person’s use of the Site (including logging into a server or account which you are not authorized to access) and pretend to be, represent, or impersonate any other individual or entity; (d) use the Site in any manner that infringes upon the legal rights of any other persons (including privacy rights and intellectual property rights); (e) copy, transmit, distribute, display, publish, transfer, sell, exploit in any way, modify, mirror, imitate, create derivative works or otherwise reproduce the Site or any of its content, including VIA HFR’s intellectual property (except when the express written authorization of VIA HFR is granted); (f) remove, alter, or destroy any Trademarks (as defined herein) or copyright notices placed on or contained within the Site; (g) reproduce, copy, modify, sell, distribute, or otherwise exploit for any commercial purposes any material, information, or service offered within the Site unless you have the necessary rights and licenses; (h) forge, alter, or modify in any way any of the materials posted or accessible within the Site; (i) reverse engineer, disassemble, decompile, or translate the Site, or extract its source code; (j) use the Site (including the posting or uploading of materials) in a manner that is inappropriate, defamatory, discriminatory or otherwise objectionable or offensive; (k) use the Site in a manner that may dilute or depreciate the name or reputation of VIA HFR; (l) use data mining, hacking, automated tools or other data gathering and extraction methods, directly or indirectly, to collect information from the Site or from any user of the Site; and (m) upload, post, transmit, publish, or distribute on the Site any viruses or other harmful, disruptive or destructive files or computer programs.

VIA HFR reserves the right to end the use, or refuse to permit the use, of the Site by any person or entity, for any reason and without notice.

Some sections of the Career portal accessible through the Site require the creation of a profile in order to access them. If you choose to create a profile, you agree to provide us with accurate information about yourself. You agree and acknowledge that you are responsible for (a) maintaining the confidentiality of the password you choose when you create your profile; (b) all activities that occur under your username or password; and (c) logging out of your profile at the end of each session. You agree to promptly notify VIA HFR of any unauthorized use of your username or password. Should you fail to comply with the above obligations, VIA HFR shall not be liable for any loss or damage arising therefrom.

Certain names, words, titles, phrases, logos, icons, graphics, or designs in the pages of the Site may constitute trade names, registered or unregistered trademarks, service marks or official marks (all described as “Trademarks”) of VIA HFR and of other persons or entities. The use of or access to the Site shall not confer or be considered as conferring a license or an authorization to use the intellectual property of VIA HFR, or its licensors. All rights are reserved.

The contents of the Site (including the materials accessible through the Site) are protected by copyright and are proprietary to VIA HFR, or its licensors.

Any unauthorized activity, including downloading, transmission or other copying or modification of Trademarks or other contents of the Site, may be a violation of statutory or common law rights and could expose the user to legal action.

YOU ACKNOWLEDGE AND AGREE THAT THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY REPRESENTATION OR WARRANTY OF ANY KIND BY VIA HFR, EITHER EXPRESS OR IMPLIED, ARISING BY OPERATION OF LAW OR OTHERWISE, WITH RESPECT TO THE SITE AND ITS CONTENT, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, GOOD WORKING ORDER, TITLE, NON-INFRINGEMENT, FREEDOM FROM COMPUTER VIRUSES, FREEDOM FROM ERRORS AND THOSE ARISING BY STATUTE OR OTHERWISE AT LAW, OR FROM A COURSE OF DEALING OR USE OF TRADE.

VIA HFR DOES NOT WARRANT THE ACCURACY, INTEGRITY OR COMPLETENESS OF THE CONTENT PROVIDED IN THE SITE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIA HFR SHALL NOT BE LIABLE FOR ANY DAMAGES OR LOSSES, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOST REVENUES, BUSINESS INTERRUPTION, LOSS OF GOODWILL, LOSS OF INFORMATION OR PROGRAMS OR OTHER DATA), HOWSOEVER CAUSED, ARISING OUT OF OR IN CONNECTION WITH, DIRECTLY OR INDIRECTLY, THE USE OF THE SITE, ANY INFORMATION OR CONTENT AVAILABLE ON THE SITE, ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, UNAVAILABILITY, DEFECT, DELAY IN OPERATION OR TRANSMISSION, SYSTEM FAILURE, COMPUTER VIRUS OR OTHER HARMFUL COMPONENT, WHETHER OR NOT VIA HFR HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES. The disclaimers and limitations of liability contained herein apply regardless of the form of action, whether in contract, negligence, extra-contractual liability, tort, strict liability, or any other theory of law.

In this section, references to VIA HFR shall include its affiliates, as well as their directors, officers, employees, agents, and representatives.

As a condition of your access and use of the Site, you agree to indemnify, defend, and hold VIA HFR and its affiliates, as well as their directors, officers, employees, agents, and representatives harmless from any claim or demand, including reasonable lawyer’s fees, made by any third party due to or arising out of: (a) your use of the Site and the information provided on the Site; (b) your violation of the Terms or any other terms and conditions under any other agreement applicable to any information, or service provided on the Site; and (c) your violation of any rights of another user.

Any delay, failure, or omission by VIA HFR to exercise any right or power under the Terms shall not be deemed a waiver of any such right or power, which may be exercised at any time and against any person.

Links to external websites are provided for convenience only and do not constitute an endorsement by VIA HFR of these websites, or the materials, content, or services they provide. These websites are independent from VIA HFR and outside of its control.

Users should also be aware that information offered or shared on external websites is not necessarily subject to the Privacy Act or the Official Languages Act. Before using such websites, you should review their terms of use and privacy policies.

The Official Languages Act establishes when we use both English and French to communicate with members of the public. When there is no obligation to provide information in both official languages, content may be available in one official language only. Information provided by organizations not subject to the Official Languages Act is in the language(s) provided. Any information on the Site that is linked to or provided by an external website, or by a third party is available only in the language in which it was provided.

The Terms and any issue or dispute relating to the Terms, or the Site will be governed by and construed in accordance with the laws of the Province of Québec and the applicable laws of Canada, without reference to principles of conflict of laws. By accessing and using the Site, you agree to be bound by such laws, and are consenting and submitting to the exclusive jurisdiction of the courts of the Province of Québec, district of Montreal, for any dispute or disagreement arising out of the Terms or any issue in respect of the Site.

The Terms apply when you access, view, or use any of the social media pages, accounts, sites, channels and/or application(s) used and administered by VIA HFR. These channels include, but are not limited to, VIA HFR’s LinkedIn page, Twitter/X account and Facebook page.

Your engagement with VIA HFR via social media is in part governed by the terms of service of the relevant third-party social media platform providers, as well as the Terms. Users who choose to interact with us via social media should read the terms of service and privacy policies of these third-party service providers and those of any applications used to access them.

VIA HFR uses social media accounts as an alternative method of interacting with Canadians, facilitating access to VIA HFR information and services, and providing stakeholders with an opportunity to interact in an informative and respectful environment. Information posted by VIA HFR is protected under the Copyright Act.

Because social media platforms and their computer servers are managed by third parties, social media accounts are subject to downtime that may be out of VIA HFR’s control. VIA HFR accepts no responsibility for platforms becoming unresponsive or unavailable.

Social media accounts may post or display links for websites that are not under the control of VIA HFR. These links are provided solely for the convenience of users. VIA HFR is not responsible for the information found through those links, neither does it endorse those sites or their content.

VIA HFR’s decision to “follow”, “subscribe”, “like” or “post” to another social media account does not imply an endorsement of that account, channel, page, or site, and neither does sharing (re-tweeting, reposting, or linking) content from another user.

VIA HFR will read comments and participate in discussions when appropriate. Your comments and contributions must be relevant and respectful. VIA HFR will reply to comments in the official language in which they are posted. To protect your own privacy and the privacy of others, do not include Personal Information in your comments or other content you post.

VIA HFR reserves the right to edit or remove comments and contributions, and to block users, with regards to comments or contributions that:

• include Personal Information;
• include protected or classified information of the Government of Canada;
• infringe upon intellectual property or proprietary rights;
• are contrary to the principles of the Canadian Charter of Rights and Freedoms;
• put forward serious, unproven, or inaccurate accusations against individuals or organizations;
• are racist, hateful, sexist, homophobic or defamatory, or contain or refer to any obscenity or pornography;
• are threatening, violent, intimidating or harassing;
• are contrary to any federal, provincial, or territorial laws of Canada;
• constitute impersonation, advertising, or spam;
• encourage or incite any criminal activity;
• do not, in our opinion, add to the normal flow of the discussion; or
• otherwise violate the Terms.

VIA HFR reserves the right to report users and/or their comments and contributions to third-party social media service providers to prevent or remove content that is contrary to the Terms, or to the terms of service of the third-party social media platform.

Some of our employees have accounts on social media. Despite their professional affiliation with us, their posts do not represent VIA HFR’s official position. VIA HFR takes no responsibility for the content of its employees’ personal social media accounts.
